Any and all virtual goods and/or virtual currency provided by the Site, the Services, or as part of any Game are provided solely for your personal entertainment and use solely as part of your use and enjoyment of the Site and/or any applicable Game or Games. Their use is subject to these Terms and Conditions as applicable. All virtual goods and virtual currency are licensed to you, are not your personal property, and no ownership interest in them is transferred to you. The prices charged and the quantities made available, as well as the kinds of virtual goods and virtual currencies made available, may be changed by DOMINIGAMES at any time and with or without notice in its sole discretion. Any and all such virtual goods and virtual currency may also be changed or discontinued at any time with or without notice by DOMINIGAMES in its sole discretion. No virtual goods or virtual currency may ever be redeemed by you for money, services, merchandise, or other goods or items of monetary value from DOMINIGAMES or any other third party. If the Games, Service, Site or any other application provides availability transfer of virtual goods or virtual currency such transfer may not be performed in exchange of real money in any currency or form (including all types of cryptocurrencies), if such exchange takes place between players, users or any other Party, except DOMINIGAMES.

5. It is prohibited to share, transfer and give access (hereinafter “transfer”) your account, its credentials (incl. login and password) to any other legal or natural person. You may not transfer access to your Games, Site or Services, unless otherwise specified by DOMINIGAMES. Any transfer of account shall constitute a breach of the Terms and Conditions and copyright infringement.

While DOMINIGAMES uses reasonable efforts to include accurate and up to date information in the Site and the Services, as well as the Games, DOMINIGAMES makes no warranties or representations as to its accuracy. DOMINIGAMES assumes no liability or responsibility for any errors or omissions in the content of the Site, the Services and/or any Game.

When you register with DOMINIGAMES and/or this Site, the Services and/or any Game, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from DOMINIGAMES. You agree that you will not violate any applicable law, rule or regulation in connection with your use of the Site, any Service, any Game, and/or any related service nor will you interrupt or attempt to interrupt the operation of the Site, any Game, and/or any related service in any way, including without limitation, by doing any of the following:

i) using any unauthorized third-party software that intercepts, or otherwise collects, information from or through the Services;

iv) using any third-party software that allows you to have an advantage in game playing that was not intended by the Game’s design and/or using game chats for transmitting information about such programs;

v) using any software that allows you to acquire virtual goods or virtual currency in ways, not intended by the Game’s design, including cheats, trainers, developer tools intended for development or testing of the game etc. You are not allowed to distribute information via Games (including chat, nicknames etc.), Site, its forums, community pages or in any other forms.

vi) using of the Site, any Service, any Game, and/or any service offered in connection with either for purposes of promoting or advertising third party goods and/or services of any nature;

vii) disrupting or assisting in the disruption of any computer used to support the Site, any Game, and/or any Service or another individual’s access to or use of any of the foregoing; or

viii) copying, scraping, or otherwise making use of Site, any Game, and/or any Service, either in whole or in party, for purposes of or in connection with any so-called generative “artificial intelligence” technology (including, for example, MidJourney, Dall-E, Stable Diffusion, GPT-4, ChatGPT, etc.), and/or other forms of deep learning, machine learning and other artificial intelligence technologies, including without limitation any proprietary algorithms, software or systems that make use of or employ neural networks, statistical learning algorithms (such as linear and logistic regression, support vector machines, random forests and k-means clustering), or reinforcement learning.

b) Username Rules. DOMINIGAMES may change your username and/or avatar, block your registration, remove your username and/or avatar from all aspects the Site, any Game, and/or any related Service, and/or suspend or terminate your access to the Site, any Game, and/or any related Service, if DOMINIGAMES determines, in DOMINIGAMES’s sole discretion, that your username and/or avatar is contrary to these Terms and Conditions, including, without limitation, the requirements set forth in this Section 9. You may not use any name:

i) that belongs to another person with the intent to impersonate that person or that may mislead others to believe you to be the other person an employee of DOMINIGAMES;

ii) that uses vulgar or insulting language or which is otherwise offensive, defamatory, obscene, hateful, or racially, ethnically, or religiously charged, or other language DOMINIGAMES considers objectionable;

iii) that belongs to any celebrity, media personality, popular culture persona, or any other name protected by a third-party’s trademark(s), service mark, publicity rights or other proprietary rights;

iv) that is, contains, or is substantially similar to, a trademark or service mark belonging to any third party, whether registered or not;

v) that is related to drugs, sex, alcohol, or criminal activity; and/or

vi) that DOMINIGAMES otherwise finds offensive and/or inappropriate for any reason, in DOMINIGAMES’s sole discretion.

c) Rules Related to Use of the Site and Games and other Services. If you download or otherwise access the Site, any Game, and/or any other content and/or Services provided DOMINIGAMES and breach the terms and conditions associated with that access, or otherwise use and/or access such Game or content in a manner that DOMINIGAMES deems inappropriate (including without limitation any behavior that DOMINIGAMES in its sole discretion finds to be offensive, unlawful, harassing, pornographic, promoting nudity, racial or ethnic hatred in any manner), then your use of this Site, any such Game, any Service, and/or your user account may be immediately terminated or suspended in DOMINIGAMES’s sole discretion.

DOMINIGAMES reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide DOMINIGAMES with such cooperation as is reasonably requested by DOMINIGAMES.

18. The provisions of these Terms and Conditions are for the benefit of DOMINIGAMES, its affiliates and its third-party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

19. This agreement shall be governed by and construed in accordance with the laws of Cyprus, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Your remedy with respect to a digital content that is not delivered within a reasonable amount of time is to either receive a replacement of such digital content, or a refund of the purchase price paid for such a digital content. Our obligation to deliver the digital content to you shall be complete at such time as, and place where, you first receive the downloaded digital content. Furthermore, we will not supply any Products or services to you until your credit card issuer has authorized the use of your card for payment of the digital content ordered.

DOMINIGAMES may place links to the Content on Google Play, AppStore and Amazon or any other digital store. You may purchase the Content via mentioned digital stores. In case of such purchase these terms of sale do not apply (Terms and Conditions and Privacy Policy still applies).

Please note that specific age restrictions may apply to certain events or happenings and to the purchase of tickets to attend any such events or happenings. As a consequence, please read carefully the product webpages of any events you plan to attend before purchasing any tickets. DOMINIGAMES reserves the right to refuse access to any events and happenings to anyone who fails to prove their age through valid photo ID.

8. Payment methods

When you purchase Content via this Store, you may pay for your purchase using the payment method (the “Payment Method”) that we identify on the Store. Please note that you will be bound by your chosen Payment Method provider's terms and conditions, such as for example Stripe. 9. Refunds

DOMINIGAMES does not offer refunds for Content purchased through the Store unless as otherwise specified herein and subject to any rights you may have under applicable law. In case of damaged goods, goods of unsatisfactory quality or goods in an unsellable condition please contact DOMINIGAMES Customer Support for information on refunds. Any such requests will be dealt by DOMINIGAMES on its sole discretion.

9.1 Right of Withdrawal for residents in EU/EEA

If you reside in the EU/EEA, you have the right to withdraw from a purchase of Content within fourteen (14) days without giving reason. The withdrawal period expires fourteen (14) days from the day the Content was delivered to you. In order to exercise your right of withdrawal, please contact us. In order for you to meet the withdrawal deadline, it is sufficient that you send us your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. Please note that if you choose to exercise the right of withdrawal, you bear the cost of returning the goods to us. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER DOMINIGAMES NOR ITS LICENSORS OR DISTRIBUTORS SHALL BE LIABLE TO YOU FOR ANY LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, OR ANY FORM OF INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FROM ANY CAUSES OF ACTION ARISING WITH RESPECT TO THE PRODUCTS OR SERVICES THAT YOU PURCHASE ON THE STORE, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. NOTWITHSTANDING THE FOREGOING, NOTHING CONTAINED IN THESE TERMS OF SALE LIMIT DOMINIGAMES’S LIABILITY TO YOU FOR FRAUDULENT MISREPRESENTATIONS, DEATH OR PERSONAL INJURY CAUSED BY DOMINIGAMES’S NEGLIGENCE, OR ANY OTHER LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE EXCLUDED OR LIMITED AS A MATTER OF APPLICABLE LAW.

11. Claims

Any claim you bring against us relating to your purchase must be submitted to us within reasonable time after you became aware of, or should have become aware of, the circumstances giving rise to a claim, and under no circumstances later than the minimum claim time permitted under applicable law.
